Varie.ai Terms of Service

1. Acceptance of Terms

By using the Varie.ai website, application, or AI companion services ("Platform"), you ("User") agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, you must not use the Platform.

2. About This Agreement

A Terms of Service, also referred to as Terms of Use or Terms and Conditions, is a legally binding agreement between you and Varie.ai regarding your use of our services. Naming your agreement differently (ToS or Terms of Use) has no legal difference.

3. Definitions

  • Platform: Varie.ai's AI companion service, including Agents, voice/text interfaces, and web data integrations.
  • Agent / AI Companion: Custom-trained AI agents provided on the Platform.
  • Marka: An Agent that provides real-time financial and market data.

4. Service Overview

Varie.ai delivers customizable AI companions that integrate live web data with natural voice and text interactions to assist with work, learning, or entertainment.

5. Integrations & Login

  • Supports OAuth login via Google and Discord.
  • Upon first login, user accounts are created automatically on our backend, with acceptance of these Terms monitored via click‑through consent.

6. Use of Service

  • You may use agents like Marka for market data, news feeds, and insights.
  • This is informational only—not personalized financial, legal, tax, or investment advice.
  • Users assume responsibility for all decisions and are urged to consult qualified professionals as needed.

7. Prohibited Conduct

Users must not:

  • Rely solely on market data from Marka or other agents for financial or investment decisions.
  • Use the Platform for illegal or manipulative financial conduct.
  • Reverse-engineer, tamper with, or interfere with Platform or OAuth integrations.

8. Financial Disclaimer

Disclaimer: All content—including from Agents like Marka—is for informational and educational purposes only. It does not constitute financial, tax, legal, investment, or trading advice, nor serve as a recommendation to buy, sell, or hold any security or asset.

No warranties (express or implied) are made regarding accuracy, completeness, or reliability. Past performance is not a guarantee of future results. Use of the service is at your own risk. Please consult licensed professionals before making any decisions.

9. Intellectual Property

All technology, interfaces, data feeds, models, and branding are owned by Varie.ai or its licensors. No rights or licenses are granted to Users except as explicitly outlined in these Terms.

10. Liability Limitation

To the fullest extent permitted by law:

  • Varie.ai is not liable for any indirect, incidental, special, punitive, or consequential damages.
  • For Users who have paid for services, our total liability is limited to the subscription fees you've paid in the six (6) months immediately preceding any claim.
  • These limitations do not apply in cases of gross negligence, willful misconduct, or intellectual property/confidentiality breaches.

11. Termination Rights

We may suspend or terminate access for violations of these Terms. Users may terminate by discontinuing use, but obligations accrued before termination will survive.

12. Governing Law & Disputes

These Terms are governed by the laws of California, USA. Any dispute will be resolved in California state or federal courts.

13. Changes to These Terms

We may update the ToS at any time. We will post updates and notify Users when possible. Continued use after updates constitutes acceptance of the changes.

14. Browser Extension (Varie Mate)

These additional terms apply to your use of the Varie Mate browser extension (the "Extension").

Extension License

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension on compatible web browsers for personal, non-commercial use, subject to these Terms.

Acceptable Use

When using the Extension, you agree NOT to:

  • Use the Extension to collect, harvest, or scrape data from websites without authorization
  • Attempt to reverse engineer, decompile, or extract source code from the Extension
  • Use the Extension to harass, abuse, or harm others
  • Circumvent rate limits or abuse prevention measures
  • Use the Extension for any illegal purpose

AI Companion Interactions

The AI companion generates responses using artificial intelligence. These responses are for entertainment and informational purposes only, do not constitute professional advice (legal, medical, financial, etc.), may occasionally contain errors or inaccuracies, and should not be relied upon for critical decisions.

Data and Privacy

Your use of the Extension is subject to our Privacy Policy, including the Browser Extension section. You can disable "Session Memory" to prevent storage of browsing context. You can use the Extension as a guest without creating an account. You can request deletion of your data at any time.

Service Availability

The Extension requires an internet connection to function. We do not guarantee uninterrupted availability, compatibility with all websites or browser versions, or continued support for specific features. We may modify, suspend, or discontinue the Extension at any time with reasonable notice when possible.

Updates

The Extension may automatically update to provide new features, security patches, or bug fixes. Continued use after updates constitutes acceptance of any modified terms.
